Yes, we had armed robbery and other common crimes, but terrorism was different because the people involved were not afraid to die. “So, you need a different mechanism to confront terrorism, you need superior technology, so that you will be able to stop them even before the attack.

We never had the equipment, but when we were confronted, we started acquiring and before I left office we built reasonable capacity and I believe with what we left behind and also with what the new government will acquire, they will be able to prosecute this terror war to a reasonable conclusion.

” Speaking on the crisis rocking the People’s Democratic Party (PDP), Jonathan admitted that the party is unstable because it is yet to recover from its loss in the 2015 general elections.

He stated; “The pdp definitely will have some minor issues, it is expected. We lost the presidency and definitely we will have
some kind of leadership problems.

“When you have a president, everybody looks up to the president. But when you no longer have the president, it becomes difficult for the party to have strong leadership.

“I believe whatever you observe will be sorted out. Leaders of the party, elders of the party have been meeting and all this
perceived disagreement will soon be sorted out.

“Every political party has misunderstanding, it is not new, it is
always there. From the beginning of PDP,
even before I got to Abuja as a vice president and president, there were instances when the chairman of the party will be asked to step down. And some officers leave from time to time when there are issues.

So, what is happening is not new but I promise you that pdp will stabilize.
“In fact, by March this year, we are going in to elect officers at the lowest levels of the wards to the local government, to the
states, to the zones, then of course the national officers will be elected; that is just in March. So the party will bounce back,
whatever you are perceiving, it always happens and we will get over it”

The ex-president is yet to react to the ongoing probe of the $2.1billion arms procurement, which former National Security Adviser (NSA), Sambo Dasuki, allegedly diverted and shared to some PDP members and former army chiefs.

The Lagos State Government on Tuesday said it would no longer allow social functions and parties in public schools just as owners of pr*vate schools across the state have been warned to comply with rules and regulations guiding their operations.

The Deputy Governor of the State, Dr. Mrs Idiat Oluranti Adebule who disclosed this while briefing the media on the strategic focus of Governor Akinwunmi Ambode’s administration on education for 2016, said the Governor had directed that schools should no longer be used for social functions.

She said: “The Governor has directed that schools will no longer be used for social activities any longer. We want to implore members of the public to report any school that violates this directive and we would ensure that defaulting schools are sanctioned accordingly.”

Adebule, who also oversees the Ministry of Education, said the state government was putting a searchlight on the standard of education in the pr*vate schools, saying it will no longer be business as usual for such schools that undermine best practices.

OVER 50 million active accounts in the banking sector will be enlisted in the new revenue drive of the Federal Government with the takeoff of the N50 stamp duty on financial transactions.

The Central Bank of Nigeria (CBN) has already communicated the commencement of the N50 stamp duty deduction on receipt of financial value of N1000 and above from bank accounts to financial institutions.

However, only transfers from personal account to another personal account, both at the same bank or another bank are exempted from the charge.

With the act already in force, there are projections that the total number of direct cash lodgements in various accounts in banks, the transfer of cash arising from Point of Sale, Automated Teller Machines and mobile money transactions, among others, may hit 50 million in volume per day, with an estimated value of about N2.5 billion daily.

The recently concluded phase of the Bank Verification Number (BVN) project had identified 22 million unique identities in bank accounts, which own over 30 million other accounts spread across the banking sector.

According to the CBN, the stamp duties are deductible on deposits into accounts and borne by the receiving accounts. Yet, another reliable source in the banking sector argued that the revenue earnings capacity of the stamp duties – when estimated moderately, given the improved payments system environment of the country, both in public and pr*vate sectors of the economy – shows that there will be no fewer than 25 million deductible transactions per day, which will amount to N1.25 billion daily.

While expressing optimism on the potential return of effective taxation, a professor of entrepreneurship and political economy, Pat Utomi, told The Guardian that there would be the need for caution to ensure that the pace of tax expansion does not depress consumption and growth.

“Nigeria,” he said, “has a challenge with no easy answers. For a long time, oil receipts made taxes an irritation to those who govern. The result was that the citizen was disconnected from holding the public official accountable. Costs in government went cr@zy. As oil revenue declines and taxation is rediscovered, the needful will be challenged in two directions.

“In one direction, from policy makers we must take care in ensuring the pace of tax incidence expansion does not depress consumption and growth. Still, the financing gap needs to be bridged by an optimal level of borrowing and new taxes.”

Utomi continued: “At the same time, deep cost-cutting in a wasteful system needs to be implemented. In the other direction, citizens need to know that a return of dependence on taxation for governing will reduce uncertainty in the budget process. When Value Added Tax (VAT) was introduced years ago there were issues raised about it but it has been a useful tax.”

The Managing Director and Chief Economist, Africa Global Research, Standard Chartered Bank, Razia Khan, said the N50 stamp duty enforcement was necessary, given the urgent need to drive higher revenue collection of the country. He said there was no foreseeable “detrimental effect on financial access in the long-term.”

Stakeholders have also commended the move, advising however, that to get the best of the policy, the authorities should strengthen the payment system to ensure that most transactions in the economy are routed through the banking system.

According to the Head of Investment Research at Sterling Capital Limited, Sewa Wusu, the move is legal and now adopted due to the circumstances the country is going through, which have heightened macroeconomic issues.

“This is another fiscal strategy to meet budget spending. Transactions are going on everyday in the financial system and this is the more reason to believe that the Nigerian economy is capable of financing itself. Though some will complain, but for me, this is a fiscal response. The act has been there and this shows that there are other opportunities in the economy. This type of law is also obtainable in other jurisdiction.

“No matter what pains we may feel from this policy, we can take it in good faith, at least as a sacrifice to the nation. N50 is money, but it is not too much to pay,” he said.

On his part, Shehu Mallam Mikail, the National President of Constance Shareholders’ a$$ociation of Nigeria, in an electronic mail to The Guardian, said although Nigerians would ordinarily expect a more vibrant tax regime, a flat N50 flat charge on any receipt whatsoever from third-party deposits or transfers would work against the spirit of the apex bank’s banking inclusion policy.

“These charges will not encourage Nigerians to have interest in the banking system any longer because people will prefer to do their transaction on cash basis without going to the bank. Moreover, the cashless policy will no longer be effective leading to low-profit margins for banks.

“Therefore, government is now saying that Nigerians should not imbibe the culture of banking. Low-income farmers and artisans might not bother about using the banking system when it comes to financial transactions. If bankers are no longer getting enough inflow of currency transactions, how can there be a dividend for shareholders of banks?”

Mikail posited that should the stamp duty be implemented the way government wished to go about it, it should have been a flat rate charged on yearly basis.

“I am worried about the interest of Nigerians in the banking system, operators’ drive for customers and returns for shareholders in the sector through enhanced economic activities,” he said.

A civil society activist, Jide Ojo, also agreed that the enforcement of the stamp duty law is a welcome development, but only raised concern about the remittances of the deducted values.

“Will the banks pay these N50 deductions to the coffers of the Federal Government? It should be noted that government is having serious issues getting organisations collecting Value Added Tax on its behalf to remit the five per cent collected to government.

“Transparent and accountable mechanisms must therefore be in place so that the public is duly informed about income from this source and what it is being used for. There should also be adequate sensitisation of the banking public on this law,” he said.

The Executive Director, Corporate Finance, BGL Capital Limited, Femi Ademola, affirmed that the stamp duty has a legal backing by the Stamp Duty Act of 2004, noting that it is just that Nigeria has not been enforcing most of the revenue generating laws and thus, not collecting the necessary revenue.

“Although the amount of N50 per transaction appears to be small, the cumulative total of revenue in a year could be very significant. It is estimated that over 400 million banking transactions through Automated Teller Machines (ATMs), Over The Counter (OTC) cash transactions, POS and Internet transfers took place in 2014. Since half of that involves receipts of money, we could infer that a sum of N10 billion could be generated from banking transactions alone this year,” he said.

On the immediate impact of the enforcement, he admitted that it could negatively affect the financial inclusion and cash-less policy of the Central Bank of Nigeria (CBN).

“This is because the bulk of banking transactions are below N100,000, according to the CBN. A further analysis could show that the largest proportion of the transactions is between N1,000 and N10,000 to which a charge of N50 per transaction could be significant. This would, therefore, mean that a large population of the people that we are trying to include in the formal financial system may be discouraged from using the banks.

“However, we must understand that tough times require tough measures as the enforcement of the stamp duty is necessary and also legal. Like it has been said at so many forums, managing Nigeria through the current crisis is not the responsibility of the government alone.

“We, the citizens, all have to contribute to our economic survival. Due to the prolonged oil price decline, our economic stability is being threatened. To survive the current crisis will require very painful decisions to be made and implemented and the pain will be felt across board,” he said.

Already, CBN has opened an account with the name “CBN NIPOST Stamp Duty Account No. 3000047517” where banks will offload the total monthly deductions from a designated account operated by respective banks.

The Nigerian Attorney General and Minister of Justice, Abubakar Malami, during an interactive session with the House of Representative Committee on Justice, revealed that the Nigerian government will soon repatriate more of the infamous Abacha loot held in foreign accounts by the former military President,General Sani Abacha.

The amount to be received, the minister revealed, is $750 million (approximately N150 trillion). An additional N2 billion, stolen by the uk convicted, former Governor of Delta State,
James Ibori, is expected to be returned soon.

The minister stated that: “In respect of the recovery of looted a$$ets, the ministry will engage in an agreement waive policy of using mutual legal a$$istance agreements or other bilateral and multilateral instruments to seek cooperation with other jurisdictions to ensure the repatriation of illicitly-acquired a$$ets in foreign jurisdictions.

“The collaboration will equally involve the engagement if foreign based counsel will attend to matters on behalf of the federal government. Low- hanging fruits being targeted in this initiative include $750 million Abacha loot as well as the £6.9 million of the Ibori loot.”

“In the long run, the ministry will be in a position to coordinate the recovery of billions of dollars in foreign jurisdictions, based on current estimations.”

“It is equally necessary to highlight the fact that the ministry’s current liability for judgment debt is in the region of N75 billion.

“The ministry has however proposed the sum of N16 billion to meet a portion of the outstanding sum in 2016, out of which the budget office has proposed an extremely low sum of N 709,155, 140.00 which does not meet even one percent of the outstanding judgment debts.”

The Nigeria Football Federation has apologized to the Federal Government and the good people of Nigeria for the Super Eagles’s failure at the 4th African Nations Championship in Rwanda. Leading the Group C table before kick –off of the final matches on Tuesday, the super eagles failed to fly in a 0-1 defeat by Guinea in Rubavu that eliminated Nigeria from the continental houseparty in Rwanda.

NFF President Amaju Pinnick reiterated that the African Nations Championship is “both developmental and preparatory for bigger challenges,” and said without mincing words that the Federation would now shift focus to the qualification race for the bigger Africa Cup of Nations.

“We apologise to Nigerians for the poor outing of the super eagles in Rwanda, but we toe the line of CAF which states that CHAN is a developmental and preparatory competition. Of course, as Nigerians, we love to win always, and we feel bad when we don’t.

“I want us to take the positives from this tournament. A player like Chisom Chikatara broke onto the global platform and players like Usman Mohammed, Chima Akas, Ikechukwu Ezenwa, Austin Oboroakpo and Ifeanyi Mathew confirmed their cla$$.

The Edo State Government has accused the state chapter of the Peoples Democratic Party (PDP) of plotting to blackmail the state governor ahead of the 2016 gubernatorial election in the state by turning the Christian and Muslim communities in the state against him.

In a Tuesday statement by the Special a$$istant to the Governor on Media Affairs, John Mayaki, the government accused the state Chairman of the PDP, Dan Orbih of fanning religious embers and seeking to turn Christian and Muslim faithful against the ruling All Progressives Congress and the person of the Governor.

Recall that Oshiomhole is currently serving his second and last term in office, but has vowed to have a hand in picking his successor.

Mayaki said: “Orbih alleged, weekend, that Oshiomhole stopped the Muslim community from accessing the stadium for a scheduled programme and that the government marked over 60 churches in the Government Reserved Areas, GRA, Benin City for demolition. For me, this recent ploy by Orbih is symptomatic of the drowning man and the fast drowning party, the pdp. If anything, it exists in Orbih’s imagination. The state government and Oshiomhole have a good and cordial relationship with the various religious bodies in the state and hold them in high esteem.

“Importantly, Orbih’s recent approach, after series of failed attempts by brandishing fake vouchers to incite the people against the government is to show how desperate his party wants to occupy Osadebey Avenue. For me, this is actionable and I urge the good people of the state, both the Muslims and the Christians alike to condemn it.”

Minister of Power, Housing and Works, Babatunde Fashola, has denied any suggestion that contracts and concessions granted in the power sector under the privatisation programme will be cancelled to pave way for new ones.

Fashola, who spoke at the weekend during the Nigerian pension industry strategy implementation roadmap retreat, said that cancelling the concessions, particularly those to local investors, would send the wrong signal to the international community about the country’s ability to honour contracts.

He said, “The question I ask is this: if we needlessly cancel concessions granted to our own people, what incentive and a$$urance do we give to outsiders to invest if the investment of our own people is not secure in their land. If you consistently horse-whip your own children in your home, why should I let my own children visit your home?”

According to him, no responsible government hastily cancels contracts involving local and international entities without considering the long-term effects of such an action.

Fashola explained that rather than outright cancelations, the government would call for renegotiations of the contracts and concessions where the need arises.

The minister decried the practice where newly formed governments begin a review of all contracts signed by their predecessors, cancel or frustrate them even when they are performing, saying that what they do inadvertently is to create a climate that diminishes the sanctity of contracts, and negatively affecting the ease of doing business.

“It is a practice that is particularly prevalent on the African continent and, I argue, that in some part contributes to our continent’s deficiency of infrastructure. I am not saying that government must not terminate non-performing contracts. Indeed these are rights that are standardly provided in all well drawn contracts; what I am saying is that contracts cannot be terminated or frustrated on trumped up reasons simply because a new government does not like the affiliation of the holder of the contract.

“It weakens the economy, it frustrates enterprise and leads to poverty and unemployment through job losses, loans taken from banks are endangered and the knock-on effect is more than we often can see on the horizon, because the bad word spreads around the global investment community very quickly like wildfire.

“Yes it may be the case, sometimes, that the past government did not act in good faith, or even compromised or was even negligent. The answer is not cancellation, if the contract is performing; the answer is renegotiation.

“You can invite the holder of the contract, confront him with evidence of compromise, bad faith or recklessness, and this is easy to get if there is diligence, and you propose new terms,” the minister stated.

Fashola, whose keynote address was entitled, “Overcoming the Challenges and Managing the Risks and Constraints that Inhibit the Investment of pr*vate Capital and Funds in Nigeria’s Infrastructure Landscape in Order to Make a Visible Economic Impact,” said the time had come for Nigeria to look into how it can harness the money in its contributory pension funds given the falling oil prices and dwindling revenue.

He said it was regrettable that given the growing size of the funds from the contribution, much of the money had largely been invested in government purse when there are places where it could be more impactful.

Fashola noted that with the right attitude to diversification, utilising the huge fund contributed by Nigeria’s working cla$$ showed that the national economy is bigger than the challenges posed by the dwindling oil prices.

He noted while African countries are literally sitting on a pot of money with 10 top pension funds in sub-Saharan Africa totalling $310 billion, most countries on the continent have been scurrying after loans from multilateral agencies, including the Chinese government which is offering $20 billion loans to the whole of Africa.

“It is estimated that Sub-Saharan Africa’s 10 largest pension fund markets had approximately $310 billion in a$$ets recently. But while these funds are not serving the real sector of roads, bridges, hospitals, rails, airports, fee paying universities, there is a palpably visible poverty in most of these countries, some of who gathered to seek funding support in South Africa recently at the instance of the Chinese Government which offered funding support (loans) of $20 billion for all of Africa, when 10 pension funds had $310 billion to invest.

Many of these countries, he noted, were scurrying after multilateral agencies looking either for aid or loans, while sitting literally on a pot of money.

He said: “If Africa is poor today, it is not because of a lack of resources; rather it is likely a poverty of ideas or the abundance of risk elevating attitudes, some of which I have alluded to, such as judicial and political, and these must change.”

He noted that the attitudes that once mired pension funds management in scandals and lack of transparency had led to very stringent legislative interventions that limited the scope of activities that pension funds could participate in.

“For example, until recently, the Nigerian Pension Fund Law limited the contributor from using part of his pension to secure a mortgage. How, one may ask, is a person supposed to finance or part-finance ownership of a home if he cannot use his own savings.”

Making recommendations, Fashola said investment outlets that the pension funds can be invested in include roads that can be tolled, like housing, the 4th Mainland Bridge, the Coastal Road linking several coastal states from Lagos to Bayelsa; the new seaport in Lekki and Badagry, the refinery by Dangote, Ajaokuta Steel, a petrochemical plant in the Niger Delta; the broken textile mills in the North and South of Nigeria that require new equipment and disciplined fiscal, technical and organizational management; prison in each of the six geopolitical zones of Nigeria that can help strengthen our justice system and decongest the colonial prisons we have kept as relics of our own sense of justice; they are in hostels for students in Nigerian universities, embedded power plants in the universities, most of which have teaching hospitals and provide an opportunity to power education and healthcare. The list is endless.”

According to Fashola, the time for it is now.

“This is the biggest opportunity to act towards diversification rather than sloganize about it. This is the time to show that our nation and our national economy is bigger than the challenges posed by the dwindling oil prices. This is the time to diversify and change the face of our economy once and for all. But the risks that stand in the way are caused by us and they must be changed by us.”

The minister also advocated the predominant use of arbitration if the pr*vate capital funded concessions and PPPs would succeed in the country, saying a situation where a case that has to do with public pr*vate contract or investment would last for years was anti-investment.

He cited the case of the Lagos Ibadan expressway where work had since stopped as a result of court cases involving the federal government and contractors, pointing out that the easiest and more acceptable way to resolve disputes arising from investment transactions was arbitration.

The minister also advised judges deciding commercial disputes to act in a commercial and expeditious manner and refrain from granting injunctive orders that will stop the business, adding that a worrisome number of power projects are caught up in protracted court cases while the nation waits for electricity to drive the economy.

The Independent National Electoral Commission (INEC) has fixed Feb. 13 for the Demsa, Lamurde and Numan Federal Constituency re-run election in Adamawa.

This is contained in a statement signed by Mrs Rifkatu Duku, Head of Information, Adamawa INEC Office, and made available to News Agency of Nigeria (NAN) in Yola on Monday.

“The Independent National Electoral Commission in the state wish to inform all stakeholders about the re-run election for the Demsa, Lamurde and Numan Federal Constituency in Adamawa.

“The election is scheduled for Feb. 13, 2016,” the statement read in part.

She said that the election, which is to take place in Demsa, Lamurde and Numan local government areas would hold in all the 30 wards that made up the federal constituency.

The statement urged all stakeholders involved to prepare for the election.

It could be recalled that in November last year a Federal Court of Appeal sitting in Abuja nullified the election of SDP’s Kwamoti Laori and ordered for the re-run election.

The National Examinations Council (NECO) on Monday said that it was concluding plans to migrate from the Paper-Pencil-Test mode to the Computer Based Test (CBT) mode for its objective examinations.

The registrar of the council, Prof. Abdulrashid Garba, told the News Agency of Nigeria (NAN) in Lagos.

NAN reports that the management of the council had, in 2015, announced plans to adopt the CBT mode for its objective questions.

According to him, migrating into the CBT will make the examination less cumbersome but be cost effective.

“We have almost finalised the procedure on the CBT mode for our objective examinations.

“As soon as we have a governing board in place, the plan will be tabled before it for discussion and approval. How soon this is achieved, depends on the Federal Government.

“We are, equally, working toward a complete migration to the CBT for all our examinations.

“It is not easy to conduct theoretical, practical and oral components of our examinations.

“We are, however, currently talking with some pr*vate firms on the possibility of using CBT mode for those other examinations,’’ Garba said.
